These Terms and Conditions (“Terms”) govern the use of the website www.keel.delivery (“the Website”) and all services provided by Oleg Anufriiev, operating as a self-employed worker (Autónomo) in Spain.

By accessing or purchasing from this Website, you agree to these Terms.

We operate as a ship-supply and delivery service providing goods and coordination services to seafarers and vessels calling at the Port of Valencia (Spain).

2. Products and availability

• All products offered on the Website are subject to availability.
• Packaging or appearance may vary depending on stock.
• Prices displayed online are indicative and may vary depending on supplier pricing, stock fluctuations, or availability.
• The final price is confirmed before delivery and may be lower than the indicative online price.

3. Prices, taxes and VAT exemption

• All prices are shown in EUR (€).
• Prices may include or exclude VAT depending on the buyer’s circumstances.
• For deliveries to international vessels, VAT exemption may apply according to Article 21.2 of Spanish VAT Law (Ley 37/1992).
• VAT, when applicable, is applied only to goods/services that are not eligible for exemption.
• A valid vessel name, IMO No, and Flag must be provided to determine VAT eligibility.

4. Orders and Payments

• Orders can be placed online or directly through Keel Delivery.
• Payments are accepted:
  • online by card,
  • cash or card upon delivery onboard.
• Payments are accepted in EUR (€) and USD ($); exchange rates apply.
• An order is considered confirmed once payment is received. By placing an order, the client certifies that the information provided is correct.
• As a general rule, the payment is authorized, and the final charge remains pending for up to 7 days or until the best available price is secured, whichever is shorter.

5. Delivery

• Delivery is available within the Port of Valencia and nearby terminals.
• Deliveries are made directly to the vessel after berth confirmation.
• Delivery time may vary depending on:
  • port restrictions,
  • security checks,
  • vessel schedule changes,
  • weather,
  • access conditions.
• We will coordinate with the vessel or agent to confirm berth details.

6. Cancellations and Returns

6.1 Cancellations

• Orders can be cancelled before delivery to the vessel. After delivery, cancellations are not possible.

6.2 Returns

• Damaged or defective items may be returned or replaced within 30 days.
• For hygiene reasons, items such as personal care products and underwear cannot be returned once opened or tried on.
• Refunds are issued to the original payment method.

7. Product authenticity

• All products supplied are original and authentic, sourced from authorized distributors or legal salers.
• We do not sell imitations or counterfeit goods.

8. Limitation of Liability

We are not responsible for:

• temporary unavailability of products,
• minor variances between product descriptions and actual items,
• delays caused by port security, customs, vessel schedules, or weather,
• any losses arising from circumstances beyond our control.

The Website may include links to third-party sites.
Keel Delivery is not responsible for their content, privacy practices, or accuracy.

10. Coordination service for shore visits

10.1 Nature of the service

Keel Delivery provides a coordination and escort service for visits in Valencia.
We are not a travel agency and do not sell package travel, combined travel arrangements, transportation services, or attraction tickets.
Our role is limited to organising, accompanying, coordinating timing, and providing on-ground support.

10.2 What the client purchases

The client purchases only our professional coordination service fee.
Any transport, access arrangements or logistical steps we perform are internal operational means, not services sold separately.
We do not operate as a carrier, agent, or reseller of travel services.

10.3 Transport

• Transport is arranged exclusively with licensed taxi/VTC providers.
• Transport costs we incur form part of our internal operating expenses and are not charged as a standalone service.
• The performance and liability for transport rest solely with the licensed provider.

10.4 Port access & meeting point

Due to Port of Valencia security rules:

• Transport cannot access the berth or arrive beneath the gangway.
• All meeting points for excursions are located at the main port gate / terminal security gate.
• The client must present themselves at the agreed time with valid identification.

We are not liable for delays caused by:

• port or security controls,
• traffic,
• weather,
• decisions of the Port Authority,
• vessel instructions.

Such delays do not automatically entitle the client to refunds (fee or disbursements). Each refund will be assessed on case-by-case basis.

10.5 Prices & invoicing

Keel Delivery does not sell attraction tickets to clients. If we assist in facilitating access during the visit, this does not constitute a ticket sale.
If, exceptionally, a ticket is purchased under express client authorization, it is treated as a disbursement (suplido) in the client’s name and invoiced separately from our service fee.

VAT is applied only to our fee.

10.6 Changes & cancellations

• Our fee: refundable according to the cancellation policy displayed at checkout.
• Disbursements: non-refundable unless permitted by the supplier. We will request refunds from suppliers where possible but cannot guarantee approval.

10.7 Authority & data use

The client authorizes us to use their identification data solely for:

• reservations,
• coordinating port access,
• purchasing third-party services,
• obtaining supplier receipts.

This service does not constitute package travel under Directive (EU) 2015/2302.

10.8 No partnership or agency

Use of licensed third-party providers does not create a partnership, joint venture or agency relationship with Keel Delivery.
We do not assume third-party obligations.

11. Data Protection

Personal data is processed in accordance with our Privacy Policy, compliant with GDPR and Spanish LOPDGDD.

12. Governing Law

These Terms are governed by Spanish law.
Any disputes shall be submitted to the courts of Valencia, Spain.
